GENERAL PURCHASE CONDITIONS

These Purchase Terms and Conditions govern the use of the website adolfodominguez.com (hereinafter "The Website") of which Adolfo Domínguez, SA (hereinafter Adolfo Domínguez) is the owner. Adolfo Domínguez, SA is a corporation established in San Ciprián de Viñas, Polígono Industrial, Calle 4, Parcela 8 - 32901 Ourense, Spain, with tax identification number A-32104226, registered in the Ourense Mercantile Registry, Volume 189, Folio 125, Inscription 8ª, Page OR-1325 and with e-mail address: contacto@adolfodominguez.com/ contact@adolfodominguez.com (hereinafter Adolfo Domínguez).

The use of the services of the online store by the customer presupposes, in any case, adherence to the Purchase Terms and Conditions in the version published at the time of the purchase order. It is therefore advisable for the customer to read these General Conditions before proceeding to make a purchase.

    1. CONTRACT SCOPE

      These Purchase Terms and Conditions apply to the sale of all Adolfo Domínguez products through its website in the following country Spain. If you do not reside in the countries indicated, you will only be able to purchase items through the online store if the shipping address of the order is in the country indicated.

      Adolfo Domínguez informs that its website is intended exclusively for an audience over age 18. Adolfo Domínguez reserves the right to cancel the access account of a customer if fraudulent, speculative or bad faith acts are detected in the use of this service.

    2. PRICE

      The applicable prices are those indicated on the website on the date of the order. They are detailed in each item and include V.A.T. (Value Added Tax), or the corresponding tax.

      Once you have completed the purchase order, and before making he payment, you will be provided with a final summary identifying the item(s) purchased and their total price (including shipping and taxes).

      Prices on this website are shown in Euros.

    3. PAYMENT

      Payment will be made upon completion of the purchase process and will be an indispensable condition for the formalization of the purchase. Methods of payment accepted:

      • Credit or debit card Visa®, Mastercard® as well as 4B or 4B Maestro debit card, American Express, U-Pay and PayPal System as well as any other form of payment approved by Adolfo Domínguez from time to time. In any case, the payment method is selected during the purchase process on the corresponding screen.

        We use secure payment systems of leading financial institutions, in order to provide maximum security. You must notify Adolfo Domínguez any undue or fraudulent charge on the card used for purchases, by email or telephone and as soon as possible so that we can make the appropriate arrangements. Suppliers or issuers of payment methods may adopt anti-fraud measures that involve the rejection of certain types of transactions. Adolfo Domínguez is not responsible for the implementation of such security policies.

        Adolfo Domínguez will issue the invoice in the name of the individual or company placing the order, you can request it through your online account. To this end, by accepting these Terms and Conditions of Purchase, you consent to the sending of the electronic invoice. At any time you can request, through contacto@adolfodominguez.com, to receive a paper invoice. We warn that sales invoices may not be subsequently modified in compliance with current regulations.

       

    4. DELIVERY

      The delivery time will be a maximum of 30 calendar days from the purchase date. The delivery of the orders will be made at the address indicated by the customer according to the following characteristics:

      4.1 Home delivery

      If the order is equal to or greater than 50€, shipping is free. If the order does not exceed 50€, standard shipping costs 5€.

      The address you provide may be a home address, a place of business or any other address you provide. It is not necessary that the billing address and shipping address match. Our transport provider will send you an email or SMS (if you have provided a contact cell phone number in your order) indicating the day of delivery and allowing you to change the delivery date. On the day the delivery is scheduled, our transport provider will send you an email or SMS (if you have provided a contact cell phone in your order) informing you of the approximate delivery time slot.

      4.2 Store pickup

      Customers can pick up their order at Adolfo Domínguez stores. You must select "Pick up in store" during the purchase process and mark the store where you want to pick up the order. A list of all the stores available for this type of pick-up will be displayed. Adolfo Domínguez will send an email, once the order has been delivered to the selected store, so that you can pick it up.

      The customer will have until 15 days after the order is available to pick it up. In the event that after this period, the order has not been delivered to the customer, for reasons not attributable to our Company, we will understand that the customer decides to withdraw from the contract and we will consider it terminated.

      Therefore, we will reimburse the payments made (including the shipping costs of the initial delivery) without undue delay and, in any event, no later than 14 calendar days after the date on which we consider the contract to be terminated. The reimbursement will be made by the same payment method that was used to make the payment.

      4.3 Collection at a point of convenience

      You must select "Drop Point" during the purchase process and mark the store where you want to pick up the order. A list of all the stores available for this type of pick-up will be displayed. The transport company will send an email or sms, once the order has been delivered to the selected store, so that you can pick it up.

      4.4 Delivery incidents

      If the delivery cannot be made due to the absence of the receiver, the transport agency, after two unsuccessful attempts, may leave the order at the nearest point of convenience (pick up) for collection by the customer. If after 15 days the customer does not pick up the order, will return the goods to the origin, so you must contact the transport agency to arrange a new delivery.


    5. RETURNS AND CANCELLATION

      There are different procedures for the realization of returns and cancellations. Below, we will describe the characteristics of each of them, as well as their costs and conditions.

      1. Return: in case of tare or defect.
      2. Withdrawal: by decision of the customer..

      Due to the special characteristics of certain products, the following must be taken into account:

      • For reasons of health protection and hygiene, we do not accept returns or cancellations of underwear, swimwear and earrings, when the wrapping, packaging or seal protecting the product has been opened, except for those that are damaged or defective.
      • All products to be returned must be properly wrapped.
      • Gift cards and gift packs cannot be returned as they are indivisible and cannot be returned separately.
      • In case of withdrawal: (i) the products to be returned must not have been used, must be properly wrapped and protected, and with the original label and (ii) you will only be liable for the diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

      5.1 RETURNS (in case of defects)

      • Conditions:Adolfo Domínguez shall be liable for any non-conformities manifested within the period established by legal regulations.
      • Refund: Adolfo Dominguez will reimburse the corresponding amount (including shipping costs for the initial delivery) within 14 calendar days from the date that has been informed of the return. The refund will be made by the same payment method used to pay, However, we may withhold the refund until we have received the goods, or until you have provided proof of the return of the goods, depending on which condition is met first.
      • Procedure:

        * Return in physical store: The easiest way to make a return is to go to one of our physical stores (except El Corte Inglés and airports).

        * Home or office pick-up: If you prefer, you can request a free pick-up at the address that suits you best. To do so, follow these steps:

        1. Request a refund: If you are registered at www.adolfodominguez.com the return request will be very simple. You just have to log in and access directly to your customer area, enter the order containing the garment to be returned ("View order") and click on the option "Request a return". In case you have made the purchase without registration, you can request it by contacting us at contato.pt@adolfodominguez.com or by calling our Customer Service from Monday to Friday from 8:00h to 13:00h and from 14:00h to 17:00h.         2. Packaging: Wrap the items and close the box. You will receive an email with the link to the carries's website, fill in your data and print the sticker that you must attach to the order.
        3. Submit package: Deliver the box properly closed to the carrier.
        4. Receive a refund: The refund will be made within a maximum of 14 working days in the same payment method.

        *Convenience point: If you prefer, you can request a free pick-up at a convenience point if you are a registered customer from your customer account. You will then receive a QR code or a label so that when you drop off the item, properly packaged, you can present the QR code or hand it in with the label.

      5.2 WITHDRAWAL

      • Conditions: you have the right to withdraw the contract without justification within 14 calendar days of receipt of the product.
      • Refund and Procedure: the same conditions shall apply as in case of a refund.

      5.3 CONTRACTUAL RIGHT OF WITHDRAWAL.

      • Conditions: in addition to the legally recognised right of withdrawal mentioned above, we grant you a period of 30 days from receipt of the product to return the products (except for those mentioned in clause 5, for which the right of withdrawal is excluded).
      • Refund and Procedure: the same provisions shall apply as in the case of repayment.

    6. PRODUCT AVAILABILITY

      In the event of any supply issues or if there are no products left in stock, we will inform you immediately and refund the amount of the out-of-stock product(s). We will refund the corresponding amount without undue delay and, in any case, within 14 calendar days. The refund will be made in accordance with Clause 5.

    7. WARRANTY ON PURCHASED PRODUCTS

      The guarantee offered is the one established in the Real Decreto Legislativo 1/2007, of November 16, which approves the revised text of the Ley General para la Defensa de los Consumidores y Usuarios. Adolfo Domínguez performs in each campaign a photographic work to show the garments as real as possible. However, items may be subject to color variations depending on the calibration of your monitor.

    8. CUSTOMER SERVICE

      Our Customer Service Department will help you with any questions or queries related to the purchase process, information about shipments and returns, tracking your order or any other questions related to our physical shops. You can contact us:

      Our Customer Service will attend to your claim, which will be registered with an identification code, and will respond to it as soon as possible, and in any case within a maximum period of one month. If your request is not satisfactorily resolved, you may go to the ordinary courts or process your claim through the website http://ec.europa.eu/odr , which will provide a single point of access for out-of-court resolution free of charge.

    9. CHANGE OF TERMS AND CONDITIONS OF PURCHASE.

      Adolfo Dominguez reserves the right to modify at any time these Terms and Conditions of Purchase. No modification will affect orders already in progress.

    10. FORCE MAJEURE

      Adolfo Domínguez's performance of all or part of its obligations shall be suspended in the event of an act of God or force majeure preventing or delaying performance. The following shall be considered as such, in particular, without this list being exhaustive: war, riots, insurrection, social unrest, strikes of any nature and supply problems not attributable to Adolfo Domínguez.

      We will inform you of any such fortuitous event or force majeure within seven days of its occurrence. In the event that such suspension lasts longer than fifteen days, you will then have the chance to cancel the order in progress and we will then proceed to refund it under the conditions provided for in point 5 of these Terms and Conditions of Purchase.

    11. APPLICABLE LAW AND JURISDICTION

      These Terms and Conditions of Purchase are subject to the Spanish law. Without prejudice to the foregoing, the non-resident consumer in Spain also enjoys the protection guaranteed by the mandatory provisions of the law of the country where he has his habitual residence. The parties submit, at their option, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the customer's address.

    When is the deadline for exchanges and returns after the confinement is over?

    We have now restored our timeframes for exchanges and returns back to 30 calendar days.

    What is the Click & Collect service?

    The Click & Collect is a service available only in Spain and Portugal. You can pick up your order at Adolfo Domínguez stores. You have to select "Pick up in Store" during the purchase process and mark the store where you want to pick it up. A list will be displayed showing all the stores available for this type of collection.

    Adolfo Domínguez will send an email, once the order has been delivered to the selected store, so that you can pick it up.

  3. OBVERSE

    The return and exchange policy is shown on the back of the ticket.

    REVERSE

    These general conditions apply to returns and exchanges of items purchased in Adolfo Domínguez stores located in Spain (except for franchised stores and corners located in El Corte Inglés stores and airports managed by Áreas, SAU). Please keep this ticket.

    1. Deadlines. Returns: Legal warranty (in case of tare or defect of the article): The deadline for the return is 2 years from the date of purchase. Commercial warranty: The return period is 30 calendar days from the date of purchase.

      * Changes: The deadline for changes (size and color) is 30 calendar days from the date of purchase.


    2. Procedure. It is essential to present the purchase receipt or invoice. The amount paid will be refunded in the same payment method in which it was paid. In the case of payment by credit card, the refund will only be made to the holder of the card with which the purchase was made. In operations with gift voucher, the amount will be refunded if the purchase receipt is presented, in case of not having it, a return voucher will be issued (without expiration date) for the amount corresponding to the returned item.


    3. Applicable conditions. In case of commercial warranty and exchanges, the items must not have been washed, used and/or repaired, and must present the internal tags. Items that cannot be returned or exchanged: cocktail, underwear and/or costume jewelry (except for legal guarantee). Exchanges and/or returns of products purchased in Adolfo Dominguez Outlet are only allowed in these establishments.

      NOTE: Purchases made in franchised establishments may be returned in our own stores, and vice versa, only by means of a return voucher.

      * We have available Complaint Forms according with consumer regulations.

  4. 360 SERVICE SHOPS

    The 360 Service allows the customer to make a purchase of an article not available in shop, with subsequent delivery in shop or at home, within a maximum period of approximately 15 days from the date of purchase. The 360 Service requires the customer to provide the establishment with the following personal data: name, surname, mobile, email, landline and full address, in order to manage the purchase.

    Adolfo Domínguez, S.A. will not transfer your data to third parties, except in the cases legally foreseen or authorized. You may exercise your rights of access, rectification, deletion, opposition, limitation of processing, portability and the right not to be subject to automated decisions.     360 SERVICE OUTLET

    The 360 Service allows the customer to make a purchase of an article not available in outlet shop, with subsequent delivery, within a maximum period of approximately 15 days from the date of purchase. The 360 Service requires the customer to provide the establishment with the following personal data: name, surname, mobile, email and landline.

    Your personal data will be processed in accordance with the regulations governing the protection of personal data and will be included in the "customer" file, owned by Adolfo Domínguez, SA and the Franchisee (*). The processing of the data is based on the execution of a contract, consequently they will be kept for a period of 6 years, from the last purchase made, and will be kept blocked until the prescription of possible liability actions.

    Adolfo Domínguez, S.A. will not transfer your data to third parties, except in the cases legally foreseen or authorized. You may exercise your rights of access, rectification, deletion, opposition, limitation of processing, portability and the right not to be subject to automated decisions.   5. Only for deliveries in Spain (mainland). Once the payment has been made, please confirm that you have read and agree with the applicable terms and conditions. You must make the payment through the link that we will send you by WhatsApp. You will receive a confirmation email with the details of your order. Shipping time: 72 hours. Free shipping: orders > 50 euros. Fee of 3,50 euros: shipments < 50 euros. Returns/withdrawal: the customer must send (at his expense) the item to the same store where the purchase was made; once received, the company will process the return.

  6. USE. Acquisition and/or use of the Card implies complete acceptance of these general conditions, available at www.adolfodominguez.com. The Gift Card is the property of ADOLFO DOMINGUEZ, S.A. (hereinafter AD), which is the issuing party, therefore the holder is a mere custodian of the same. The Card can be used to purchase any item on sale in the brick-and-mortar stores located in Spain and Portugal (except online, airports and corners in El Corte Inglés), and cannot be used in points of sale in other countries. The value of this card can be €50, €100 or €200. The customer receiving the Card cannot request a reduction or increase in the value of the same, nor request a refund. The Card can be used as many times as desired until the total amount for which it was issued has been consumed, at which time the Card will be made available to AD. If the purchase exceeds the balance available on the Card, the difference can be paid in cash or through any other form of payment accepted by AD. The available balance will appear on the receipt each time that a purchase is made using the Card. Before leaving the point of sale, the user of the Card must verify the available balance reflected on the mentioned till receipt. Unless proven otherwise, the balance available on the card at each moment will be that determined by the card reader used in the AD points of sale. The Card can be used during sales and/or promotional activities. Multiple Gift Cards cannot be jointly used for one single purchase.

    RETURN. The products acquired with the Card are subject to AD's returns and exchange policy. In the case of a return of the purchase made with a Card, it is necessary to attend a brick-and-mortar store and present the purchase receipt. Refunds will not be made in cash, only exchanges for another product of the same value or higher (paying the difference), or a Refund Card can be issued for the corresponding amount.

    VALIDITY. The gift card does not expire.

    RESPONSABITY. Responsibility for the use and custody of the Card corresponds exclusively to the holder. AD will not be liable if the card cannot be used as a payment instrument due to deterioration, loss or theft of the same.

    These General Conditions for Use are subject to Spanish legislation.
