GENERAL OPERATING CONDITIONS FOR ADN CLUB

These general conditions (the “General Conditions”) regulate the ADN Club loyalty club (the “Program” or “ADN Club”) by ADOLFO DOMINGUEZ, S.A (“ADSA”), trading entity with address at Polígono Industrial, calle 4, parcela 8, de San Cibrao das Viñas (Ourense) and TIN A-32.104.226.


    1. ADN CLUB REGISTRATION PROCESS.

    The member’s account is personal and non-transferable and must be in the name of a natural person, of legal age and resident in Spain, who must identify themselves in accordance with point 5.1.

    Within the period of 24 hours, you will receive an email or SMS confirming your registration, with a link to the website adolfodominguez.com, where you can find an updated version of the General Conditions accepted. Said Conditions will be stored in an electronic format, which will remain available to you, in English, at all times at adolfodominguez.com and Adolfo Domínguez physical stores. Identification as a member when purchasing will imply, in any case, knowledge and acceptance of these Conditions. ADSA may communicate with you via email, adolfodominguez.com, SMS, telephone or letter.


      2. ADN PREMIUM REGISTRATION PROCESS.

      You can register with the Premium category: (i) free of charge if you spend €6,000 or more per year, or (ii) through the subscription model: (i) monthly, for thirty euro (€30) and (ii) annual, for three hundred euro (€300).

      2.1 Subscription model.

      The registration process using the subscription model takes place in accordance with the procedure described in point 1 and the description below:

      • Registration with the monthly model is exclusively available through the online store.

      • Registration with the annual model is available on online stores and any physical Adolfo Domínguez stores located in Spain, with the express exclusion from the ADN Premium program of stores located in outlets, the online outlet and corners located in El Corte Inglés.

      You must provide a valid and current form of payment, which you can update when deemed necessary. Unless you cancel your subscription prior to the invoice date, you authorise us to charge the subscription fee corresponding to the next invoice cycle to your form of payment.

      The subscription fee will be charged to your form of payment, on the payment date specified on the page “My Account”. The length of your invoice cycle will depend on the type of subscription chosen when you registered (monthly subscription or annual subscription). In some cases, the invoice date can change, for example if your form of payment has not been set up correctly or if you changed your subscription plan.

      If the form of payment registered does not allow payment of the Subscription fee, Adolfo Domínguez may suspend your access to the Premium level until the Subscription fee has been paid.

      2.2 Redeem the subscription amount in your purchases. 

      Customers who access the Premium level by paying a subscription can redeem the amount of said subscription in their purchases. Upon subscribing, the amount paid will be charged as ADN Premium Credit to your account, available for use on your purchases.

      Monthly subscriptions generate credit from the second month. From then on, members can redeem their €30 within the monthly subscription period. Annual subscriptions generate credit from the time they are subscribed. From then on, members can redeem their €300 within the annual subscription period.

      In any of the cases, members can use their ADN Premium Credit over several purchases and are not obliged to redeem it all in a single purchase.

      The ADN Premium Credit:

      • Cannot be redeemed at outlet stores, online outlets and/or corners at El Corte Inglés.

      • At physical stores and on adolfodominguez.com, it cannot be accumulated with any other type of voucher and/or promotional code and/or private sales and/or ADN CLUB Refund.

      • It can be used to purchase full price or discounted items.

      • It cannot be used to purchase gift packs, sunglasses, gift cards and/or fragrances. It cannot be used for shipping costs for online orders, tailoring expenses and packaging and/or gift wrapping expenses.

      If the items acquired in the purchase are fully or partially returned, the amount paid for the items and the ADN Premium Credit redeemed will be refunded provided they are still valid.

      NOTE:

      ADN Premium members who registered before 24/10/2024 will receive a €300 voucher with a validity of 12 months, for one single use. If the full amount is not used, any leftover will be lost. If a mixed purchase is made, the amount of the purchase paid for with the voucher will not be refunded.


      3. OPERATION OF THE PROGRAM

      The Member must identify themselves when making any purchase or requesting application of program benefits in any of our stores. The purchases are automatically registered on the Member’s account at the time of purchase. For the purposes of global calculation, transactions made in a single store and on the same date will be considered a single purchase.


      4. CATEGORIES AND BENEFITS OF THE PROGRAM

      Participation in ADN Club and/or ADN Premium allows the member to enjoy a series of benefits.

      There are three levels at ADN CLUB, depending on the value of the purchases made by the member over the previous 12 months. At the end of the day, the general review process will be done for the ADN CLUB categories, calculating the amount spent during the 12 months prior to that day. In the case of a change of level, the benefits associated to the new level will become valid from the time of this update.

      When a new member joins the ADN Club, they do so directly at the Bronze level, at least until the next review of levels in the Club.

      4.1 Categories: The ADN Club consists of the following levels, in application of certain criteria:

      • Bronze: this category will be assigned to new members and will be maintained by all Members that spend, over the period, less than €499 (four hundred and ninety nine euro).
      • Silver: this will be assigned to ADN CLUB members who spent, in the previous period, €500 (five hundred euro) or more but less than €1,999 (one thousand nine hundred and ninety nine euro).
      • Gold: this will be assigned to ADN CLUB members who spent, in the previous period, €2,000 (two thousand euro) or more but less than €5,999 (five thousand nine hundred and ninety nine euro).

      4.2 Program Benefits: Upon registering in the program and identifying as a member in the Store, you can enjoy the benefits detailed below.

      1. Earn an ADN CLUB Refund on the amount spent, provided that said amount was spent in Store.
      2. Redeem an ADN CLUB Refund to purchase products that are on sale in the Stores.
      3. Advantages, benefits and promotions that are exclusive to ADN Club, depending on the level.

    1. EARN ADN CLUB REFUND
    2. The Members can obtain an ADN CLUB Refund for all of the purchase made in Store (in the case of purchases in El Corte Inglés, the refund accumulation process will be reflected in the member’s account within a period of 1 to 3 days) except for purchases made at the online outlet or through the first completed Challenge.

      Members will not accumulate ADN Club Refunds for:

      • Purchases made without providing identification before completing the sale. For the purchase to generate a refund, it must be linked to the customer’s profile at the time of the transaction. Exceptions will only be considered in cases of technical issues or duly justified incidents.

      • Unidentified purchases Pending sales or product reservations: When a member reserves a product, El Corte Inglés generates an initial receipt. If the reservation becomes a sale, a second receipt is issued. This second receipt will only be valid for accumulating a Refund in the ADN Club program if it is processed through the ADSA (ICG) terminal and the member provides identification.

      • Special conditions or promotions by El Corte Inglés: No Refund will be accumulated for purchases made through promotions at El Corte Inglés, such as discounts on the ECI purchase card, payment in instalments, financing or other actions not managed by ADN Club.

      • The amount corresponding to the shipping costs for online orders, tailoring expenses and packaging and/or gift wrap expenses.

      ADN CLUB Refund is accumulated:

      • Based on a percentage of the net amount (once other payments with ADN CLUB Refund have been subtracted).

      • Through certain actions carried out by the member other than the purchase of products, as listed below (hereinafter, the “Challenges”).

      • Through Challenges completed, other than purchasing Products, that are listed below:

      Anniversary: once (1) a year, the member will receive a €2 ADN CLUB Refund on the anniversary of their registration with ADN CLUB.

      Level change: when a member changes level, they will receive a €1 ADN CLUB Refund. The accumulation of ADN CLUB Refund with this challenge will be limited to once a year (once for rising from Bronze to Silver and once for rising from Silver to Gold).

      Purchase of gift pack: when a member purchases a gift pack, they will receive a €1 ADN CLUB Refund. If the gift pack is returned, the ADN CLUB Refund accumulated with said purchase will be cancelled. If there is not enough ADN CLUB Refund available at the time of the cancellation, the maximum possible will be cancelled. In the ADN BOX service it is not possible to redeem ADN CLUB Refund AND PREMIUM credit.

      The member will be notified of the ADN CLUB Refund obtained through the website adolfodominguez.com, Customer Service Centre and/or in store. The update can take up to 72 hours.

      If a purchase is returned, whether totally or partially, upon identification, the purchase receipt must be presented to cancel the ADN CLUB Refund accumulated with said purchase. If there is not enough ADN CLUB Refund available at the time of the cancellation, the maximum possible will be cancelled.

      In the case that the ADN CLUB Refund was used for the purchase, the refund will be as follows: If the return is total, the ADN CLUB Refund used in the purchase is reactivated, updating the date of validity/expiry based on the new reactivation date. If the return is partial, the ADN CLUB Refund corresponding to the items returned will be reactivated.

      • Validity and expiry of ADN CLUB Refund.

        The Refund has a validity of twelve (12) months from the day it accumulates.
        Refunds granted because of the member’s birthday will have a validity of one (1) month from the day it accumulates.
        Refunds granted as part of a specific marketing action will have a validity of one (1) month from the day it accumulates.
        After the periods mentioned above, the ADN CLUB refund will automatically be deactivated.


    3. REDEEM ADN CLUB REFUND.
    4. The ADN CLUB Refund can be redeemed for discounts in purchases that the member makes in our Stores in Spain and Portugal. The ADN CLUB Refund cannot be redeemed in corners located in El Corte Inglés or outlet stores and/or online outlets.

      The ADN CLUB Refund does not need to be redeemed in a single purchase. The amount not used will remain available on the customer’s profile to be used when they wish, provided that it is within the valid period.

      The Refund will only be applied to full price items, on the initial RRP for the product (tax included) and will have a total maximum limit equivalent to fifty per cent (50%) of said original price. The ADN CLUB Refund cannot be transferred or exchanged for cash or for its value in kind.

      In the case that the purchase amount exceeds the amount of ADN CLUB Refund available to the member, they will have the option of “mixed payment”, which allows the combination of payment with money (cash or card) and ADN CLUB Refund. The use of the ADN CLUB Refund generates more ADN CLUB Refund for the amount of the difference in price paid in cash and/or card.


      The ADN CLUB Refund cannot be used:
      • To purchase a Gift Card: the ADN CLUB Refund is generated in favour of the person purchasing the Gift Card, for the total amount of the same. However, the person using said Gift Card as a means of payment will not generate ADN CLUB Refund for purchases made with it.
      • For purchases of gift packs, sunglasses, gift cards and/or fragrances.
      • For shipping costs for online orders, tailoring expenses and packaging and/or gift wrapping expenses.

      The ADN CLUB Refund cannot be accumulated with discounts on the Premium level (30% linear discount, Premium balance, subscription voucher, birthday voucher) or any otpher type of voucher, promotional code and/or promotions in private sales.


    5. ADVANTAGES, BENEFITS AND PROMOTIONS EXCLUSIVE TO ADN CLUB.
    6. Rules applicable to all categories.

      Cashback: The ADN CLUB Refund accumulates based on a percentage of the net amount (once other payments are discounted with ADN CLUB) of the purchases made by the member, identified as such, in one of our Stores. The ADN CLUB Refund will be accumulated in round numbers (e.g. if the customer spends €76.20, only €76 will be calculated. Rounding is always downward).
      Welcome voucher: redeemable in the next purchase by entering the voucher code up ompleting their purchase in our Store. Promotion valid from when the code is issued until 15 days later for items in the present collection (with or without discount). Not applicable to gift packs, sunglasses, gift cards and fragrances are excluded from this promotion. Cannot be redeemed at outlet stores, online outlets and/or corners at El Corte Inglés. Cannot be accumulated with any other type of voucher, ADN CLUB Refund, promotional code and/or promotions in private sales. In the case of total or partial return of the items acquired in the purchase, it will be deactivated once the voucher is redeemed, with the amount corresponding to the items being refunded but not the amount of the “Welcome Voucher”.

      • C1. BRONZE. Members that belong to the Bronze level can enjoy the following advantages: .

      1. 5% cashback: Bronze members will accumulate 5% of their purchases as ADN CLUB Refund (every €1 spent will become €0.05 of ADN CLUB Refund)
      2. 15% welcome: Once registered with the ADN Club, the member will receive a single voucher with a 15% discount.
      3. €5 ADN CLUB Refund for your birthday: The ADN CLUB Refund will be generated for each Bronze member on the day they have stated as their birthday.
      4. Private sales and access to exclusive promotions: On specific dates, the member will have access to private sales and/or exclusive promotions for the Bronze level.
      5. Informative content: The Bronze members will receive informative content via e-mail, adolfodominguez.com, SMS, Mobile Wallet push notifications, telephone or letter.


      • SILVER. Members that belong to the Silver level can enjoy the following advantages:

      1. 10% cashback: Silver members will accumulate 10% of their purchases as ADN CLUB Refund (every €1 spent will become €0.10 of ADN CLUB Refund).
      2. 15% welcome: Once registered with the ADN Club, the member will receive a single voucher with a 15% discount.
      3. €10 ADN CLUB Refund for your birthday: The ADN CLUB Refund will be generated for each Silver member on the day they have stated as their birthday.
      4. Private sales and access to exclusive promotions: On specific dates, the member will have access to private sales and/or exclusive promotions for the Silver level.
      5. Informative content: The Silver members will receive informative content via e-mail, adolfodominguez.com, SMS, Mobile Wallet push notifications, telephone or letter.
      6. Invitations to events: The Silver members will periodically receive invitations to exclusive events held by ADSA.


      • GOLD. Members that belong to the Gold level can enjoy the following advantages:

      1. 15% cashback: Gold members will accumulate 15% of their purchases as ADN CLUB Refund (every €1 spent will become €0.15 of ADN CLUB Refund).
      2. 15% welcome: Once registered with the ADN Club, the member will receive a single voucher with a 15% discount.
      3. €15 ADN CLUB Refund for your birthday: The ADN CLUB Refund will be generated for each Gold member on the day they have stated as their birthday.
      4. Informative content: The Gold members will receive informative content via e-mail, adolfodominguez.com, SMS, Mobile Wallet push notifications, telephone or letter.
      5. Invitations to events: The Gold members will periodically receive invitations to exclusive events held by ADSA.


      • PREMIUM. Members that belong to the Premium level can enjoy the following advantages:

      1. They will not accumulate ADN Club Refund but can enjoy a 30% linear discount on full price items in our Stores except for corners located in El Corte Inglés, online outlet and outlet stores. Cannot be accumulated with any other type of voucher (except for the birthday voucher), promotional code or ADN CLUB Refund.
      2. 15% welcome: Once registered with the ADN Club, the member will receive a single voucher with a 15% discount. Validity and conditions for redeeming in section 4.2.C.
      3. €30 voucher for their birthday: The voucher will be generated for each Premium member on the day they have stated as their birthday. In physical stores, cannot be accumulated with any other type of voucher or ADN CLUB Refund. At adolfodominguez.com, cannot be accumulated with any other type of voucher and/or promotional code and/or ADN CLUB Refund.
      4. Private sales and access to exclusive promotions: On specific dates, the member will have access to private sales and/or exclusive promotions for the Premium level.
      5. Informative content: Premium members will receive informative content via e-mail, adolfodominguez.com, SMS, Mobile Wallet push notifications, telephone or letter.li>
      6. Invitations to events: Premium members will periodically receive invitations to exclusive events held by ADSA.
      7. Free subscription to ADN BOX: Premium members who decide to register for the ADN BOX service will not have to pay the subscription fee for the same (€25).
      8. Free access to ADN LIVE: Premium members can enjoy free entrance to the ADN LIVE events.
      9. Free shipping: Premium members will have the right to free shipping for all purchases made on adolfodominguez.com or in any of our Stores (through the Sale 360 service).
      10. Free basic tailoring: Premium members will enjoy free basic tailoring for seasonal and sale items in selected stores.
      11. Priority customer service: Premium members who contact the Customer Service through the same mobile number or email address they registered with will be given priority in the case queue.
      12. Free access to a Personal Shopper: On specific dates, Premium members can enjoy a free Personal Shopper service in selected stores in Barcelona and Madrid or via video call through adolfodominguez.com.
      13. Redeem the subscription amount in purchases. Premium members who access the level by paying the subscription amount can redeem the cost of the subscription in their purchases.
      14. Premium level members will accumulate ADN CLUB Refund through the Challenges but not through their purchases.


      5. MEMBER RESPONSIBILITIES.
      1. To identify yourself with your National ID number, phone number or email to enjoy the benefits of the Club.
      2. To inform changes of address, email or phone number (where applicable) in the personal profile, in writing to ADSA and/or the Customer Service Centre.

      6. ADSA RESPONSIBILITIES
      1. To maintain confidentiality of the data provided and updated.
      2. To attend to the member through the Customer Service Centre, at the telephone (+34) 919 100 808, between the hours of 9 a.m. to 2 p.m. and from 3 p.m. to 6 p.m., Monday to Friday.

      7. CANCELLATION
      1. ADSA reserves the right to revoke, at any time and without prior notification, membership to the Program in cases where non-compliance is detected with any of the Member’s responsibilities, the General Conditions, acts that are fraudulent, speculative, irregular or in bad faith, or inactivity for a period of more than 36 months. ADSA reserves the right to initiate any legal actions deemed appropriate if it detects any of the behaviours described above.
      2. The Member can also cancel their membership to the program at any time by informing ADSA of this decision in writing and identifying themselves as indicated in the Client Responsibilities section.
      3. Cancelling the program, under points 1 and 2 mentioned above, will lead to loss of all rights relative to its use, automatically from the time that the Member is no longer a member.
      4. In the ADN Premium program:
        1. Members can cancel their subscription at any time, and will continue to have access to the Premium level advantages until the end of their invoice period. Subscription payments cannot be refunded and we do not provide returns or credits for partial subscription periods or for advantages that have not been used. To cancel your subscription, go to the page “My Account” and follow the cancellation instructions. If you cancel your subscription, you account will automatically close at the end of the current invoice period.
        2. ADSA can change the subscription plans and corresponding fee with prior notice of 30 days. If you do not agree with any of these modifications, you can cancel your subscription before it enters into force.
      5. ADSA can cancel the ADN Club program at any time, due to reasons of force majeure or unforeseeable events, due to legal or other obligations and due to company policy. Only in this final cancellation situation will the member have the right to use the points accumulated during two months after the date the program is cancelled, which will be notified through adolfodominguez.com and/or points of sale.

      8. MODIFICATION OF CONDITIONS

      ADSA may modify these conditions if this is communicated to the members of ADN Club, a requirement that the parties expressly agree to have been met through publication of the variations on adolfodominguez.com and/or points of sale. If the member does not agree with these changes, they can inform ADSA of their decision to withdraw from the Club.


      9. RESPONSIBILITIES.

      If at any time the service for accumulating or using ADN CLUB Refund is interrupted due to a communications error that cannot be attributed to ADSA or due to systems improvements, the member will have the right to request accreditation of the ADN CLUB Refund not added to their account during a period of 15 natural days from the purchase by presenting the receipt proving the purchase made, but cannot enjoy the ADN Club services until communications are re-established.

      In the case of a service incident, duly justified and with documentary evidence, ADSA may authorise the member to accumulate the corresponding Refund, provided that the member identifies themselves before the end of the sale so that it can be linked to their profile.


      10. APPLICABLE LEGISLATION AND JURISDICTION

      These General Conditions are subject to Spanish legislation. The parties submit, of their own choice, to the courts and tribunals of the member’s address for the resolution of conflicts, expressly rejecting any other jurisdiction.


      11. DATA PROTECTION

      We notify the principle aspects related to the processing of your data and where you can find further information regarding privacy:

      Data manager: ADOLFO DOMÍNGUEZ, S.A (hereinafter ADSA).

      Purpose: To manage membership of the ADN Club. We notify you that we may prepare profiles for marketing purposes, in order to send communications that may be of interest to you.

      Legal basis: Formalisation of the contract and legitimate interest.

      Recipients: Data is never communicated to third parties, unless legally obliged to do so.

      Conservation periods: Until you request cancellation, given that until that time we will understand that you are still interested in forming a part of the Club.

      Rights: Providing all of the data requested is obligatory. The member has the right to access this information and can rectify, cancel, limit, oppose, request transfer and exercise the right to not be subject to automated decisions, including profiles. You can exercise your rights at dpo@adolfodominguez.com.

      You can contact the Spanish Data Protection Agency for further information regarding your rights and can file a complaint with the DPO or, where applicable, the Relevant Authority regarding Data Protection, the Spanish Data Protection Agency (https://www.aepd.es), particularly when you are not satisfied with the exercise of your rights.
